A prenuptial agreement — reliable protection of your property rights in marriage

How often have you heard that "a prenuptial agreement is about distrust"? In reality, it is nothing of the sort. It is a sensible approach to your property relations and a way to avoid future misunderstandings.

What a prenuptial agreement can govern (Article 93 of the Family Code of Ukraine)

  • Property relations between the spouses.
  • Property rights and obligations between the spouses.
  • Property rights and obligations of the spouses as parents.

Important: a prenuptial agreement does not regulate personal non-property relations (such as whose turn it is to do the dishes).

Who can enter into a prenuptial agreement?

  • Spouses.
  • Persons who have merely filed an application to register a marriage.

Key requirement: notarisation. Without it the agreement is void.
